Ludis.app respects intellectual property rights and takes well-founded copyright complaints seriously. This policy describes how we use third-party content, how to submit a notice of alleged infringement, and how to dispute an unwarranted takedown request.

1. How We Use App Images

Ludis.app publishes screenshots and visual elements of mobile applications in its editorial materials. We want to be fully transparent about how and why we do this.

1.1. Sources and Processing

App images are sourced from publicly available channels: application pages on Google Play, the Apple App Store, and official press materials provided by developers. Before publication, images undergo editorial processing — quality enhancement, cropping, and adaptation to the format of the review. This makes each published image a transformative derivative work.

Our use of app images on Ludis.app is grounded in the following legal doctrines:

  • Fair Use (17 U.S.C. § 107, United States) — images are used for editorial, critical, and informational purposes; they represent only a small portion of the original work; their use is transformative in nature; and they do not harm the market value of the original.
  • Fair Dealing (United Kingdom and EU) — images are used for the purposes of criticism, review, and news reporting in accordance with the UK Copyright, Designs and Patents Act 1988 (CDPA) and the EU Copyright Directive.
  • Transformative Use — editorial processing gives the images new meaning and context within a review, which is a recognised criterion of transformativeness under established case law.

This approach is used by leading international review platforms including The Verge, PCMag, GSMArena, and others.

1.3. We Are Not Competing with Rights Holders

Ludis.app does not distribute or reproduce applications. Publishing screenshots in the context of a review does not substitute for the original application and does not compete with it in the market — on the contrary, our editorial content directs users to official download sources.

2. DMCA Takedown Notice

If you are a rights holder or their authorised representative and believe that any material on Ludis.app infringes your copyright, please send us a written notice to [email protected].

In accordance with 17 U.S.C. § 512(c)(3), your notice must include all of the following elements:

  • Identification of the work. A precise description of the copyrighted work you believe has been infringed. If multiple works are involved, they may be listed in a single notice.
  • Identification of the infringing material. The exact URL of the page on Ludis.app where the allegedly infringing material is located.
  • Contact information. Your full name (or organisation name), postal address, phone number, and email address.
  • Good-faith statement. A statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law.
  • Accuracy statement under penalty of perjury. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are authorised to act on behalf of the copyright owner.
  • Signature. Your electronic or physical signature.

Notices that do not include all of the above elements may be rejected as improperly submitted.

We process notices within 10 business days of receipt.

3. Our Response to a Notice

Upon receipt of a properly submitted notice, we will take the following steps:

  • review the notice and assess the validity of the claimed infringement;
  • where grounds exist, remove or restrict access to the disputed material;
  • notify the user who submitted the material (where applicable) of the takedown request;
  • send you confirmation of the action taken.

If we determine that the use of the material falls within the doctrine of fair use or another applicable legal exception, we will notify you of this with an explanation of our position.

4. Counter-Notice

If you believe that your material was removed in error or as a result of misidentification, you have the right to submit a counter-notice to [email protected].

In accordance with 17 U.S.C. § 512(g)(3), your counter-notice must include:

  • Identification of the removed material and its location prior to removal (URL).
  • A statement under penalty of perjury that you have a good-faith belief that the material was removed as a result of mistake or misidentification.
  • Your contact information: full name, address, phone number, and email address.
  • Consent to jurisdiction: a statement that you consent to the jurisdiction of the federal court in the district where your address is located, or — if your address is outside the United States — that you consent to the jurisdiction of any judicial district in which the service provider may be found.
  • Your electronic or physical signature.

Upon receipt of a properly submitted counter-notice, we will forward a copy to the original claimant. If the claimant does not notify us of legal proceedings within 10–14 business days, the removed material may be reinstated.

5. False Notices and Abuse of Process

Please be aware: submitting a knowingly false DMCA notice or a knowingly false counter-notice carries legal liability under 17 U.S.C. § 512(f), including liability for damages, court costs, and attorney's fees.

Ludis.app reserves the right to document instances of DMCA process abuse and to pursue appropriate legal remedies.

6. Repeat Infringers

In accordance with DMCA requirements, Ludis.app maintains a repeat infringer policy. Users against whom multiple well-founded copyright infringement notices have been received may be permanently blocked from the Website.
